A legal separation is an agreement between spouses concerning spousal support, child custody, visitation and support, and property division. This may be used during the process of divorce or on its own.
CHOOSING BETWEEN DIVORCE AND LEGAL SEPARATION
A divorce terminates the marriage and restores the parties to the status of unmarried persons.
A legal separation formally and fully separates two parties like a divorce, but the parties remain legally married. After a legal separation is granted by the court, either party may file for divorce to terminate the marriage.
